Rental Agreement
- After the three minimum monthly payments have been made, customer has the choice of continuing the rental on a month to month basis or terminating the agreement by returning the instrument to TED BROWN MUSIC, provided the instrument is in good condition, reasonable wear and tear expected, and all rental payments are current to date of return. Customer must inform TED BROWN MUSIC of any address changes during the term of this agreement.
- Customer must return the instrument in good condition to one of the locations listed at the bottom of this contract or contact TED BROWN MUSIC for return arrangements. Customer may be released from the terms of this agreement by fulfilling the three minimum monthly payments and upon receipt of instrument in good condition by TED BROWN MUSIC. If instrument is returned prior to 3 months, customer will be billed for the remainder of such minimum. Customer will be responsible for all damage not covered by Maintenance and Replacement Guarantee.
- The instrument described on the reverse is on a rental basis only (Ownership will never transfer via this contract.) If the customer would like to purchase a band or orchestra instrument of equal or greater value the following will apply: After 12 months of continuous rental the customer will receive 10% off the TED BROWN MUSIC price. After 24 months of continuous rental the customer will receive 20% off the TED BROWN MUSIC price. After 36 months of continuous rental, and thereafter, the customer will receive 30% off the TED BROWN MUSIC price.
- A late charge of $10.00 per month will be assessed on each installment more than 10 (ten) days past due. An insufficient funds fee of $40.00 will be charged for any bank draft dishonored for any reason.
- If customer fails to make monthly payments as scheduled, the customer is obligated to either return the instrument to the store immediately, or pay the value price+ tax in full. Should default occur for more than 30 days on any monthly rental payment, TED BROWN MUSIC may take possession of the instrument and charge a repossession fee. Should collection or legal action be necessary to recover the instrument or money owed, customer agrees to pay reasonable fees.
Maintenance & Replacement Guarantee
- TED BROWN MUSIC guarantees to provide repair service, at no charge, on the instrument due to normal wear and use; excluding willful damage. Supplies such as strings, reeds, and oils are not included. Customers who permanently mark their instrument or case will be charged for its replacement upon return of the instrument. Customers who attempt to repair the instrument on their own will be 100% responsible for any damage caused.
- TED BROWN MUSIC guarantees to replace the instrument with one of comparable age and condition if the instrument is lost through fire or theft. Claim is subject to the instrument being in the student’s home or authorized school cabinet or room, and payment of a $50.00 fee. In connection herewith this replacement provision would be void if the instrument was lost in the corridor, street, playground or any unauthorized place.
- Notification of loss must be made to school authorities and the police or sheriff’s office and to TED BROWN MUSIC within 10 days of occurrence or the replacement guarantee will be void and the customer will be liable for payment in full of the balance due under this security agreement. These guarantees will be declared totally void if payments are not current (within 10 days) at the time of loss or repair.
